Can these be fully submerged at the max depth of 2m for a long period of time approx 3hrs

Yes! No problem. They are tested all for waterproof IPX8 rating for 3.6m.

Can i transfer mpeg-4 audio file (protected) (.m4p) files onto it that i have downloaded from apple music?

No it can't play protected audio files. If you stream the music from an authorised device using Bluetooth it will play them - just remember that Bluetooth has a range of about 10cm I think, in the water. So you'd need the player (something like a waterproof Apple Watch) literally strapped to your swimming goggles. Google is the your friend for looking for ways to create unprotected versions of your music for personal use - which it will play from it's on board memory quite happily.
