is there anything that must be done to preserve the condition of this while being outdoors all spring & summer? i should get some head turners on this

I would try to avoid keeping it out of the full sunlight, that might cause the paint to fade, I have mine right by the front door under a covered walkway.

Would it scare deer away? Or any other rodents?

I don't think this cougar statue is big enough to even be noticed by a deer much less be intimidated by it. It's only 22" from it's nose to the tip of it's tail and 8" high. The DT lioness for $855.00 (the last time I looked) is more life size. I have both the large lioness and large roaring lion on display in my yard and the squirrels, rabbits & opossums still come to the bird feeder. You may need to look elsewhere, other than a statue, to keep deer off your property. It really is a nice real looking statue. I created a display across the top of my buffet with this statue using rocks from the yard , sprigs of artificial plants and a candle light set to come on at night. Worked out beautifully. My mother would have loved it. As a deterrent for deer, maybe not so much.

With it saying it's used, is there any flaws on it?

I purchased mine brand-new so if you're buying a used one I can't really tell you if it has flaws or not
